The Data (Use and Access) Act 2025 has reshaped the UK’s rules on automated decision-making. From 5 February 2026, Article 22 was replaced by Articles 22A–22D, moving from a general restriction on automated decisions to a safeguards-led regime that gives organisations greater flexibility.
The focus is now on implementation. The ICO has launched a consultation on its draft automated decision-making guidance, open until May 2026.
